These Terms & Conditions ("Terms") govern your access to and use of the website gammarecruitment.com and the recruitment services, client portal and career services operated under the Gamma Recruitment name (together, the "Services"). By using the Services you agree to these Terms. If you do not agree, do not use the Services.

1. Definitions

"Gamma Recruitment", "we", "us" or "our" means the operator of the Services.
"Client" or "Employer" means any organisation that briefs a vacancy to us, uses the client portal or engages us to recruit.
"Candidate" means any person who registers a CV with us, is presented to a Client by us, or uses our career services.
"Engagement" means a recruitment assignment accepted by us for a Client under the fee model agreed in writing (including by email or through the portal).
"Career Services" means the optional paid services for job seekers described on our Career services page.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract. If you use the Services on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms.

3. Nature of the Services

Gamma Recruitment is a recruitment consultancy. We source, screen and present Candidates to Clients, and we provide optional Career Services to job seekers. We are not an employer of record for any Candidate placed with a Client and we are not a party to any employment contract that results from an introduction. All hiring decisions, employment terms, compensation, background checks and work-eligibility verification are the responsibility of the Client and the Candidate.

Live job listings are published on our job board, JobGamma, under its own terms.

4. Clients and Engagements

4.1 Vacancy briefs

Submitting a vacancy brief is a request for us to contact you; it does not by itself create an Engagement. An Engagement begins when we confirm the role, the fee model and the terms in writing.

4.2 Fee models

Fees are as published on our Engagement models & fees page or as agreed in writing for a specific Engagement. Unless otherwise agreed:

Success fee: 8.33% of the Candidate's agreed first-year cost to company (CTC), payable only after the Candidate joins. The invoice is raised 30 days after the joining date and is payable within 15 days of invoice.
Per accepted profile: a fixed fee per profile presented, by seniority tier. A profile may be rejected within 48 hours of presentation with a brief reason at no charge; profiles not rejected within that window are accepted and billable.
Contract staffing and RPO: as agreed in writing for the Engagement.

4.3 Replacement guarantee

For success-fee placements, if the Candidate's employment ends within 90 days of joining for any reason other than redundancy, restructuring or a material change to the role, we will either source a replacement at no additional fee or refund the fee pro-rata for the unserved part of the 90 days, provided the fee was paid on time.

4.4 Introductions and circumvention

A Candidate is "introduced" when we present their profile or arrange an interview. If a Client, or any entity connected with the Client, engages an introduced Candidate in any capacity within 12 months of the introduction, the applicable fee is payable, whether or not the hire is made through us.

4.5 Client obligations

Clients confirm that each vacancy is genuine and currently open, that they are entitled to recruit for it, that they will comply with applicable employment, equal-opportunity and data-protection laws, and that they will give timely feedback on presented Candidates. Clients must keep Candidate details confidential and use them only to evaluate the Candidate for the vacancy.

4.6 Client portal

Portal access is granted to named Client contacts and secured by one-time codes sent to the registered email address. You are responsible for activity under your access and must tell us promptly of any unauthorised use.

5. Candidates

5.1 No fees to Candidates

We never charge a Candidate for registration, consideration, introduction or placement. Our recruitment fees are paid by Clients. Anyone requesting payment from you to secure a role with us is not acting on our behalf; please report it to contact [at] gammarecruitment.com.

5.2 Registration and accuracy

By registering a CV you confirm that the information is true, current and yours to provide, and that you are legally able to work in the locations you indicate. You may ask us to update or delete your registration at any time.

5.3 Consent to be presented

We discuss a role with you before presenting you to a Client and do not share your identifying details with a Client without your agreement for that role.

5.4 Your data

You retain ownership of your CV and profile. You grant us a limited, non-exclusive licence to store, process and present that information solely to provide the Services, as described in our Privacy Policy. We do not transfer identifying Candidate details to any third-party AI or analytics provider.

6. Career Services

Career Services are optional, paid monthly in advance, and are not a condition of being considered for any role. They are described on the Career services page. Cancellation, refunds and delivery timelines are set out in our Refund & Cancellation Policy, which forms part of these Terms. Career Services do not guarantee interviews or job offers.

7. Communications

By submitting a vacancy, registering a CV or using the portal you agree to receive service communications by email and phone about your enquiry or Engagement. You may opt out of non-essential communications at any time.

8. Acceptable use

You agree not to: scrape or harvest data from the Services; submit false, misleading or unlawful information; impersonate any person or organisation; attempt to access another user's portal or data; interfere with the operation or security of the Services; or use the Services for any unlawful purpose.

9. Intellectual property

The Services' design, content, branding and compilations are owned by us or our licensors. "Gamma Recruitment", "JobGamma" and the associated marks are our trade marks. You may use the Services only as permitted by these Terms.

10. Privacy and cookies

Our Privacy Policy describes how we collect, use and protect personal data and is incorporated into these Terms. The Services use only essential cookies required for sign-in and security.

11. Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that any vacancy will be filled, that any Candidate will be hired, or that any Candidate or Client information is complete or accurate.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMMA RECRUITMENT AND ITS OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN ENGAGEMENT IS LIMITED TO THE FEES PAID TO US FOR THAT ENGAGEMENT, AND FOR CAREER SERVICES TO THE FEES PAID IN THE THREE MONTHS BEFORE THE CLAIM.

13. Indemnity

You agree to indemnify and hold harmless Gamma Recruitment from any claim, loss or expense (including reasonable legal fees) arising from your breach of these Terms, your use of the Services, or any employment relationship resulting from an introduction.

14. Termination

Either party may end an Engagement on written notice; fees accrued for Candidates introduced before termination remain payable under section 4. We may suspend or withdraw access to the Services where we reasonably believe these Terms have been breached.

15. Changes

We may update these Terms from time to time; material changes are reflected in the "Last updated" date above. Continued use of the Services after a change constitutes acceptance. Engagements in progress continue under the terms agreed for them.

16. Governing law and disputes

These Terms are governed by the laws of India. The courts of India have exclusive jurisdiction over any dispute arising from them, without prejudice to any mandatory consumer rights that apply to Career Services customers in their place of residence.

17. Force majeure and general

We are not liable for delay or failure caused by events beyond our reasonable control. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. These Terms, the Privacy Policy and the Refund & Cancellation Policy are the entire agreement between you and us regarding the Services.
